These Terms of Service ("Terms") govern your use of publisherads.ai (the "Service"), provided by Publishinghub LLC ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
You must be at least 18 years old to use the Service. You are responsible for keeping your account credentials secure and for all activity under your account. Provide accurate information and keep it up to date. Access is granted by invitation only.
To use the Service you must connect an Amazon Advertising account via OAuth. By doing so, you authorise us to access and manage campaigns in that account on your behalf. You are responsible for ensuring you have the right to connect any Amazon Ads account you link, and for the campaigns and spend that result from using the Service.
If you connect Amazon Ads accounts belonging to your clients, you represent that you have your clients' authorisation to do so. You are responsible for your clients' campaigns and for complying with any obligations you have to them. See our Privacy Policy for how we handle data in this context.
The Service uses third-party AI (Google Gemini) to generate performance narratives and keyword suggestions from your campaign data. AI output may be inaccurate or require review. You are responsible for reviewing any AI-generated suggestions before acting on them. Similar output may be generated for other users.
You agree not to: misuse or attempt to disrupt the Service; access accounts or data that are not yours; reverse-engineer or scrape the Service; use the Service for unlawful, infringing or abusive purposes; or share your account credentials. We may suspend or terminate accounts that breach these Terms.
Use of the Service does not override your obligations under Amazon's Advertising Policies and Seller / Vendor agreements. You remain solely responsible for the campaigns you create and their compliance with Amazon's policies.
You retain ownership of your campaign data and any content you bring to the Service. We retain ownership of the Service, software, branding and frameworks. We grant you a limited, non-transferable licence to use the Service for your own advertising operations while your account is active.
The Service provides tools and automation to help manage your Amazon Advertising. We do not guarantee any particular campaign performance, ROAS, ACoS improvement, sales or income. Outcomes depend on many factors outside our control, including market conditions, your budgets, and Amazon's algorithms.
To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential losses, or for lost profits, revenue or data, including any losses resulting from campaign activity created or modified through the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law (such as for fraud). Mandatory consumer-protection rights in your country are not affected.
You may stop using the Service and request account closure at any time by contacting support@breakthroughpub.com. We may suspend or end your access if you breach these Terms or where required for security or legal reasons. Sections that by their nature should survive termination (intellectual property, limitation of liability) will continue to apply.
Our handling of your personal data is described in our Privacy Policy, which forms part of these Terms.
These Terms are governed by the laws of the United States, without prejudice to any mandatory rights you have as a consumer in your country of residence.
We may update these Terms from time to time. The "last updated" date shows the current version. Continued use of the Service after changes means you accept the updated Terms.
